In response to a complaint by the Austrian data rights activist Max Schrems, the Court of Justice of the European Union declared<\/a> the EU-USA data protection agreement “Privacy Shield<\/a>” invalid<\/a> on 16 July 2020. This means that the second agreement on the protection of personal data of EU citizens in the USA has already failed after the “Safe Harbour” agreement was stopped about five years ago. But what does this mean for companies?<\/p>\n\n\n\n

Anyone who has processed data solely on the basis of the Privacy Shield must  switch to standard contractual clauses \u2013 otherwise there is a risk of data chaos and legal uncertainty, complains the German industry association BITKOM<\/a>. The German Federal Association of IT Users VOICE<\/a> (German only), which represents CIOs in Germany, states that it is illegal to transfer personal data to the USA on the basis of the Privacy Shield. The association also points out that even standard contract clauses are now legally controversial. But how are European companies supposed to guarantee the transfer of personal data to the USA, which is sometimes necessary for their existence, or to protect themselves against an outflow of data to the USA?<\/p>\n\n\n\n

Auf die Klage des \u00f6sterreichischen Datenrechtsaktivisten Max Schrems hin hat der Europ\u00e4ische Gerichtshof am 16. Damit ist nach dem Stopp des \u201eSafe-Harbor\u201c-Abkommens vor rund f\u00fcnf Jahren bereits die zweite Vereinbarung zum Schutz personenbezogener Daten von EU-B\u00fcrgern in den USA gescheitert. Doch was bedeutet das f\u00fcr Unternehmen?<\/p>\n\n\n\n

Wer bislang allein auf Basis des Privacy Shield Daten verarbeitet hat, muss zumindest auf Standardvertragsklauseln umstellen \u2013 andernfalls droht ein Daten-Chaos, beklagt etwa der Branchenverband BITKOM <\/a>die entstandene Rechtsunsicherheit. Und der Bundesverband der IT-Anwender VOICE<\/a>, der die CIOs in Deutschland repr\u00e4sentiert, stellt fest, dass es nun schlicht illegal ist, auf Basis des Privacy Shield personenbezogenen Daten in die USA zu \u00fcbermitteln. Der Verband weist au\u00dferdem darauf hin, dass auch die Standardvertragsklauseln rechtlich umstritten sind.
